Family enterprises in China froma legal approach

Abstract

Analyse the economic importance of this type of enterprise in China. After having identified its concept, the interest will be focused on its legal internal organisation, more concretely, on the type of company which is usually chosen by them and the main advantages of using it. This initial analysis will help to reach certain conclusions and to compare the situation of this type of enterprises in China and Spain. The growing significance of familiar enterprises inside Spanish economic framework has motivated numerous studies on this issue from a legal and economic approach. From a legal perspective, the special needs of this type of enterprises has guided the search for the company type which can satisfy them best. Once identifying the most suitable company type, it is also important to take into account the existence of different legal instruments which can be introduced in the articles of association of the chosen company type in order to adapt it to the especial characteristics of a concrete familiar enterprise. The main purpose of the company type and of these different legal instruments will be obtaining a close corporate structure where the membership can be controlled.
