Las cláusulas más injustas en los préstamos hipotecarios

Abstract

[ESP] En el presente Trabajo Fin de Grado se realiza una descripción del producto financiero denominado genéricamente como préstamo hipotecario, desde los requisitos para la concesión, los trámites de formalización,así como un detalle y posterior análisis de las cláusulas hipotecarias de mayor importancia en el proceso de negociación con el banco, ya que afectan sensiblementeal coste de la operación o a aspectos de su liquidación futura, ya sea anticipada o a término. Dedicamos un apartado del trabajo al estudio de las cláusulas del contrato más abusivas detectadas en la práctica bancaria y a su resolución. [ENG] In the present End of Degree Project, a description of the financial product generically known as mortgage loans is made. Incluiding the requirements for the grant, the formalization procedures and a detailed and subsequent analysis of the mortgage clauses which must be given particular attention in the negotiating process with the bank, since they seriously affect the cost of the operation or aspects of its future early or late settlement. A section of this project is devoted to the analysis of the most abusive contract clauses found in the banking practice and to their resolution.
