Aproximación a la noción de prestación por riesgo durante la lactancia natural

Abstract

[ESP] El presente TFM tiene por objeto el estudio de la prestación por riesgo durante la lactancia natural y pretende concretar de forma clara y simple los elementos que se deben dar para el reconocimiento de este derecho. A tal efecto se realiza un estudio en materia de prevención de riesgos laborales desde una perspectiva de género, en el que se examina la normativa aplicable, agrupada en tres bloques: normativa internacional en el ámbito de la Organización Internacional del Trabajo, normativa comunitaria en el ámbito de la unión europea, y normativa interna. Así como también se examinará la doctrina jurisprudencial que interpreta los “requisitos” que integran la procedencia de la prestación por riesgo durante la lactancia natural.Sibien la noción de prestación por riesgo durante la lactancia natural se apoya fundamentalmente en su carácter de prestación contributiva,con la que se pretenden sustituir los ingresos dejados de percibir ante una suspensión del contrato de trabajo motivada por la existencia del riesgo, el presente estudio profundiza y destaca la importancia de la existencia de otros elementos determinantes en la procedencia de la prestación, tales como,la imposibilidad de adaptación en las condiciones de trabajo, la modificación del puesto a otro que sea compatible con la situaciónexento de riesgo, o que no transcurran más de nueve meses desde el nacimiento del lactante [ENG] This bachelor dissertation aims to study of the risk benefit during breastfeeding and aims to specify clearly and simply the elements that must be given for the recognition of this right.
